Summary
This agreement authorizes Antonio Sierra Pineda, Human Talent Specialist Advisor at DIGER, to perform the duties of Human Resources Sub-manager starting April 8, 2026. He will be able to make administrative decisions about personnel and is responsible for his actions. The delegation can be revoked at any time by the Director.
Considerations
Whereas, by means of Article 13 of Executive Decree number PCM 05-2022 published in the Official Gazette "La Gaceta" dated April 6, 2022, the Directorate of Management by Results (DIGER) was created.
Whereas, the Directorate of Management by Results (DIGER) functions as a Deconcentrated Entity of the Presidency of the Republic and is directed by an official with the rank of Secretary of State.
Whereas, Article 31 of the Regulations on Organization, Functioning and Competencies of the Executive Branch establishes, in relation to deconcentrated bodies, that technical-administrative autonomy is understood as the direct management of matters that are entrusted to them by Law.
Whereas, by means of Executive Agreement No. 127-2026, the citizen ELMER MANUEL FERRERA PADILLA was appointed to the position of DIRECTOR OF MANAGEMENT BY RESULTS WITH THE RANK OF to the contracting of the aforementioned services and equipment, without affecting the attributions corresponding to the Honduran Land Transportation Institute (IHTT) in the administration and payment of the subsidy.
Whereas, the acts of the organs of the Public Administration shall adopt the form of Decrees, Agreements, Resolutions and Orders, as established in Article 116 of the General Law of Public Administration.
Whereas, the Organs of the Public Administration shall develop their activities subject to the normative hierarchy established in Article 7 of the General Law of Public Administration and in accordance with the principles of economy, expedience and efficacy in order to achieve prompt and effective satisfaction of the general interest.
Whereas, Article 116 of the General Law of Public Administration states that: "The acts of the organs of the Public Administration shall adopt the form of Decrees, Agreements, Resolutions or Orders.
Whereas, Article 122 of the General Law of Public Administration states that: "The Agreements, Resolutions and Orders shall be signed by the head of the organ that issues them and authorized by the official indicated in the legal provisions".
Whereas, Articles 4 and 5 of the Administrative Procedure Law expressly establish that: "The superior organ may delegate the exercise of its functions in a specific matter to the immediately lower organ and that the act of delegation, in addition to indicating the delegating organ, the object of the delegation may contain

ARTICLE 2: EFFECTIVE DATE. This Decree shall enter into force as of the date of its publication in the Official Journal "La Gaceta". Given in the City of Tegucigalpa, Municipality of the Central District, in the Session Hall of the National Congress, on the first of September of two thousand twenty-six.
