This resolution modifies Honduras's National Frequency Plan, opening new radio frequency bands for mobile phone services, internet, and satellite telecommunications. It benefits telecommunications companies that can compete for these frequencies through public bidding, improving coverage and internet services nationwide.

Considerations

That which is established in the Sixth Resolving Clause of this Normative Resolution modifies the Regulation of Wireless Access Systems that include Radio Local Area Networks (Wireless Access Systems/Radio Local Area Network, (WAS/RLAN)) and Short-Range Radiocommunication Devices in force, in relation to the frequency ranges described in the national note HND40A of the PNAF.

To modify the Fifth Resolving Clause of resolution NR004/24 which contains the National Plan for Frequency Attribution (PNAF), which shall be read as follows: "FIFTH: To establish that within the frequency bands attributed to the MOBILE service, for the operation of the telecommunications service called Mobile Telephone Service (which includes Personal Communications Service (PCS) and Cellular Mobile Telephone Service), the following frequency ranges shall be assigned through the modality of Public Tender or Public Auction: 453-457.5 MHz and 463-467.5 MHz; 698-806 MHz; 814-824 MHz and 859-869 MHz; 824-849 MHz and 869-894 MHz; 894-902 MHz and 939-947 MHz; 1427-1518 MHz; 1710-1780 MHz and 2110-2180 MHz; 1850-1910 MHz and 1930-1990 MHz; 2500-2690 MHz; 3300-3800 MHz, 24.25-27.5 GHz, 37-43.5 GHz, 45.5-47 GHz and 47.2-48.2 GHz. Likewise, within the frequency bands attributed to the FIXED service, for the operation of the telecommunications service called Telephone Service, Data Transmission and Switching Service and Internet Service or Access to Information Networks, the following frequency ranges shall be assigned through the modality of Public Tender or Public Auction: 2300-2400 MHz, 10.15 – 10.3 GHz and 10.5 – 10.65 GHz."

For the frequency bands 10.7-12.7 GHz, 17.3-18.6 GHz and 19.7-20.2 GHz, attributed to the Fixed Satellite Service, in accordance with the provisions of Article 22.5CA of the Radio Regulations of the International Telecommunication Union (ITU), CONATEL may evaluate and authorize the operation of non-geostationary satellite systems (NGSO) with a performance-based protection approach, taking as reference the technical protection criteria established in the document "Report and Order FCC 26-26, Modernizing Spectrum Sharing for Satellite Broadband", without prejudice to compliance with the other provisions contained in the Radio Regulations of the ITU. For such purpose, operators of NGSO satellite networks shall submit, as a prerequisite to authorization, a Sworn Declaration of Compliance and Commitment, signed by its legal representative, by means of which they declare that the operation of the system shall comply with the following: a) It shall not cause harmful interference to geostationary satellite networks (GSO), to terrestrial services operating in the frequency bands 10.7-12.7 GHz, 17.3-18.6 GHz and 19.7-20.2 GHz, to radio astronomy services, when applicable, nor to any other radiocommunication service protected by the Radio Regulations of the ITU. b) To respond immediately to any requirement from CONATEL related to the investigation of possible interference. c) To adopt the necessary technical measures to eliminate or mitigate any harmful interference that its system could cause, including power reduction, modification of operational parameters, capacity limitation, beam reconfiguration or partial or total suspension of transmissions, when so determined by CONATEL. d) To assume responsibility for the effects resulting from non-compliance with the obligations established in this Resolving Clause, without prejudice to administrative sanctions and other responsibilities that correspond in accordance with current national legislation.

That the present Resolution shall enter into force as of the day of its publication in the Official Journal La Gaceta. The following signed this Act: Attorney Fernando Francisco Anduray, Presiding Commissioner; Attorney Cesar Augusto Cáceres, Proprietary Commissioner; Attorney Vicente Daniel Salcedo, Proprietary Commissioner; Licensed Nadia Cecilia Gallegos, Alternate Commissioner; Licensed Grace Sierra, Alternate Commissioner. Executed in the city of Comayagüela, Municipality of the Central District, on the Thirty-first day of the month of August of the year two thousand twenty-six (2026). Abg. Fidelina Macías Vásquez General Secretary CONATEL 2 S. 2026.
