Considerations
Whereas, in accordance with Article 246 of the Constitution of the Republic, "The Secretaries of State are organs of the General Administration of the Country and depend directly on the President of the Republic"
Whereas, according to Article 36 of the General Law of Public Administration, the common attributions and duties of the Secretaries of State are, among others, to "Guide, direct, coordinate, supervise and control the activities of their respective offices [...] Formulate, with respect to matters within their competence, the draft laws, regulations and other acts of the President of the Republic [...] Issue the regulations for internal organization of their respective offices"
Whereas, by means of Executive Decree Number PCM-05-2022, in its Article 11, the Secretariat of State in the Office of Social Development is created, to establish social policies of a solidary, inclusive and violence-free Honduras
Whereas it is in the public interest that the institutions and organisms of the public sector have regulatory provisions from the Public Administration, which shall establish and utilize funds allocated for social assistance or donations, in accordance with the needs of real management and the entities shall prepare their own internal instructions and regulations, in which the requirements and internal regulatory shall be established for their correct application, ensuring equity and the optimal use of state resources. CONSIDERING: General Law of Public Administration Article 31. "In each Secretariat of State there shall be an Administrative Management unit, which shall be responsible, among other things, for budgetary administration functions, the administration of human resources and materials and general services, including the function of purchases and supplies…"
Whereas the Constitution of the Republic establishes that the human person is the supreme end of society and the State, and all have the obligation to respect and protect it. Likewise, it establishes that migration shall be conditioned to the social, political, economic and demographic interests of the country (articles 35 and 59)
Whereas, in accordance with the Vienna Convention on Consular Relations, consular functions include the protection in the receiving State of the interests of the sending State and of its nationals, to render them aid and assistance, within the limits permitted by international law (article 5)
Whereas the provisions of the Law for the Protection of Honduran Migrants and their Family Members are of public order and have as their purpose, among others, to establish the norms and conditions to make it possible for Hondurans abroad to exercise their constitutional rights, as well as to establish the legal framework within which the State of Honduras must exercise its protective action on behalf of Hondurans abroad
Whereas Human Mobility has existed historically in humanity and the displacement of persons either within or outside our country (migration) is a reality exacerbated by the implementation of a neoliberal economic model whose purpose has been to deepen inequalities, dependence, environmental deterioration, violence, as well as the major blockades and sanctions that are harmful to development at the regional level and which, as a product of public-private corruption and the concentration of wealth inherent to the capitalist system, resulted in major consequences of indebtedness that impoverished our country for more than a decade
Whereas, at the global level, an increasing number of migrants are forced to abandon their homes due to a complex combination of factors. According to data from the International Organization for Migration (IOM), from 1990 to the year 2024, the number of Honduran migrants has increased from 156,000 to 985,000, with the United States of America being the primary destination country
Whereas it is currently estimated that there are 1.8 million Hondurans in the United States, of whom the Department of Homeland Security (DHS) of the United States of America records, as of November 2024, a number of approximately 261,651 with deportation orders who are not in the custody of the United States Immigration Service and approximately 1,349 Hondurans with deportation orders who are in the custody of said entity, according to official data from ICE (United States Immigration and Customs Enforcement)
Whereas forced return migration to the country is a central characteristic of migration trends in Honduras, which implies significant security risks, which are worsened by limited access to civil documentation and the weakness of return and reintegration programs
Whereas despite a decrease being reflected from the year 2022 to the year 2024 in the deportations of Hondurans from the United States by at least fifty percent (-50%), the changes in the dynamics of migratory policies that have begun to be implemented by President Donald Trump, compel the adoption of urgent measures for the mitigation of the negative impact of said policies in our country
Whereas various countries in Latin America are preparing to face the social, economic and political repercussions resulting from the hardening of migratory policies by the United States of America, therefore it is necessary that the State guarantee an efficient, effective and timely response, through a protection strategy that includes programs, projects and actions in favor of Honduran migrants abroad
Whereas by means of Executive Decree number PCM 08-2025, published in the Official Journal "La Gaceta" on the date of February 8, 2025, in its edition 36,761, the National Emergency Strategy for the Protection of Honduran Migrants is decreed, where in its Article 7, the program "SISTER, BROTHER, COME BACK HOME" is created, through which actions shall be promoted for the economic and social reintegration of migrants returned to their families, to society and to the country. Likewise, services shall be promoted for an orderly return that meets the conditions of dignity and security for each Honduran man and woman to the national territory
Whereas in PCM 08-2025, in Article 7 Numeral 2, which literally states: "BONUS "YOU HAVE ARRIVED HOME" (US100). Through the Social Benefit Fund to persons of the Secretariat of State in the Office of Social Development (SEDESOL), each returned immigrant who enters through the Returned Migrant Care Centers (CAMR) in the framework of ENEPROMIH shall be provided a single bonus consisting of social assistance of ONE HUNDRED DOLLARS (US100.00) which shall be delivered in the equivalent in lempiras, with the purpose of mitigating the adverse effects of return and contributing to their gradual reintegration process. The Secretariat of State in the Office of Social Development (SEDESOL) shall issue within a period of no more than fifteen (15) days, a regulation to regulate the requirements and procedures for the delivery of the bonus, as well as to establish the mechanisms that guarantee transparency in the process, in coordination with banking and/or cooperative sector entities at the national level"
Whereas in PCM 08-2025 in article 8, which literally states: "COMPLEMENTARY ACTIONS TO REINTEGRATION. In order to facilitate the reintegration of Honduran migrants who return to the Country, the Migration Governance Council, in coordination with the Social Cabinet, shall formulate and execute immediately ADDITIONAL PROGRAMS to those previously mentioned, mainly with the following institutions. ...2. Secretariat of State in the Office of Social Development"
