Agreement DGR-137-2018 Automatic Renewal of Permits to Circulate without License Plates
- Decree: 137-2018
- Category: Notarial & Registry
Summary
This agreement allows provisional permits to drive without license plates to automatically renew every 30 days indefinitely, without needing to process each time. It aims to simplify procedures, reduce costs for citizens, and eliminate corruption opportunities while the Property Institute distributes license plates nationwide.
Considerations
Whereas, pursuant to Article 54 as reformed of the Traffic Law, the Property Institute has the responsibility to issue license plates and equally to issue provisional permits to circulate without plates for up to thirty (30) days.
Whereas, during the time the process of supplying plates and provision of financial resources previously described is being carried out, the Property Institute must take urgent and necessary measures so that, in compliance with Article 54 as reformed of the Traffic Law, vehicle owners are assured that those vehicles that temporarily circulate without plates may circulate at the national level without having to carry out complicated, cumbersome procedures that take too much time, that incur unnecessary expenses on citizens and, furthermore, that stimulate possible sources of corruption for intermediaries and public servants.
Whereas, the Public Administration requires more agile mechanisms to respond to the requirements of users, in order to provide public services in the best possible way within the framework of the Law, observing the principles of effectiveness, efficiency, probity, and subsidiarity.
Whereas, pursuant to Article 1 of the Administrative Simplification Law, administrative processes must be simplified and rationalized, in such a way that they adhere to the standards of economy, expedience, effectiveness, and spirit of service of all interested parties.
Whereas, in accordance with Articles 2.1 and 2.2 of the aforementioned Law, the Property Institute must seek to eliminate all unnecessary or repetitive regulations that obstruct the administration's processes, prevent the rationalization of the provision of a public service, and encourage inefficiency and conduct contrary to the public interest, especially that which encourages the practice of acts of corruption by interested parties, intermediaries, and public servants. Likewise, the Property Institute must align and simplify the processes, within the framework of the Law, so that decision-making is neither delayed nor hindered.
Whereas, every state body has the obligation to permanently conduct diagnoses and analyses of the different procedures and administrative processes that must be followed in its departments, in order to design simplification measures which must be adopted in accordance with the objectives of the Administrative Simplification Law.
Whereas, according to the two preceding recitals, even though there is an obligation to obtain a circulation permit for those vehicles that circulate without plates, the Property Institute may take administrative measures that eliminate the obligation to renew such permits or obtain new permits, provided that the supply of plates is regularized at the national level, with which unnecessary and redundant processes and costs will be eliminated in consumables, human resources, and time, both for the State of Honduras and for interested citizens, decidedly eliminating the incentive for intermediaries to benefit from obtaining circulation permits without plates every 30 days, as well as for public servants who attempt to obtain bribes for expediting the issuance of such permits.
Whereas, it is policy of the Government of the Republic to reduce unnecessary procedures, the simplification of administrative processes, and the fight against corruption resulting from cumbersome and complicated procedures.
Whereas, the Vehicle Property Registry administered by the Vehicle Property Registry Management is a department of the General Registry Directorate, which is why it corresponds to the latter to issue acts of a general nature on the matter.
