This law requires prepaid phone companies to withhold 12% Sales Tax when selling cards and phone recharges to wholesale distributors, using the final consumer price as the base. Companies must deposit the withheld amount in banks within the first 10 days of the following month and provide special invoices that do not generate tax credits for the wholesaler.

Considerations

That by means of Decree number 216-2004 containing the Law of Structuring of Tax Administration, the Executive Directorate of Revenue (DEI) was created, as an administrative body dependent on the Department of Finance, with domicile in the capital city and authority throughout the entire national territory.

That in accordance with Article 2 of the aforementioned Decree, the Executive Directorate of Revenue (DEI) shall be headed by an Executive Director of Revenue, who shall be responsible for the management of all taxes including customs taxes and for performing the functions of supervision, review, control, inspection and collection in the application of tax laws.

That the Agreement No. 397-2005 containing the Regulations of Organization and Functions of the Executive Directorate of Revenue, in its Article 2 establishes that: "The functions of the Executive Directorate of Revenue are: 1) To determine the tax obligations of every taxpayer in the cases provided for by customs and fiscal laws and those established in the Tax Code. 2) To determine, collect, charge, verify, control and inspect the tax obligations and their accessories of every taxpayer...26) To direct activities to facilitate the voluntary compliance of taxpayers' tax obligations, for which it must provide itself with the infrastructure and other facilities that allow a more direct relationship with the taxpayer...32) To exercise its administrative power exclusively in the management and determination of tax obligations; as well as in all other related activities in accordance with the Law."

That the Sales Tax Law establishes in its Article 1: A sales tax is created on sales made throughout the territory of the Republic, which shall be applied in a non-cumulative manner at the import stage and at each stage of sale to which goods or services are subject in accordance with the provisions of this Law and its Regulations. Article 3: For purposes of calculating the tax, the taxable base is considered as: a) In the case of goods and in the provision of services, the taxable base shall be the value of the good or service, whether made in cash or on credit, excluding direct costs of ordinary or extraordinary financing, insurance, freight, commissions and guarantees... Article 6: The general rate of the tax is twelve percent (12%) on the value of the taxable base of imports or of the sale of goods and services subject thereto.

That Article 8 of the Sales Tax Law establishes "The Executive Directorate of Revenue (DEI) may designate as agents for collection and withholding of the tax to producers and wholesale merchants when they carry out sales whose taxable base is the final consumer price. In the case to which this paragraph refers, goods transferred shall not be subject to the new tax regardless of the number of subsequent intermediaries, except in the case of provision of services taxed with this tax."

That currently the item of telephone communication services in general has grown considerably, especially in the prepaid mode. CONSIDERING: To issue an Agreement that designates the providers of telephone communication services in the prepaid mode through the sale of telephone cards and recharges, as agents for collection and withholding of the Sales Tax levied on distributors or wholesale merchants of said services and that at the same time the procedure that these companies must apply to effect the withholding and payment of the aforementioned Tax is established.
