Summary
This agreement redistributes 8.7 million lempiras from the 2018 budget: it increases funds for the Presidency's operating expenses and finances them by reducing consulting services budget. It allows the Presidential Office for Project Monitoring to operate directly under the Presidency.
Considerations
That in accordance with Article 245, items 2, 11 and 19 of the Constitution of the Republic, it is the responsibility of the President of the Republic, among other Powers: To direct the general policy of the State and represent it, issue Agreements, Decrees and issue Regulations and Resolutions in accordance with the Law, as well as administer the Public Treasury.
That in accordance with Article 248 of the Constitution of the Republic, it establishes that the Decrees, Regulations, Agreements, orders and Actions of the President of the Republic must be authorized by the Secretaries of State in their respective departments.
That in accordance with Article 16 of the General Law of Public Administration, the President of the Republic may delegate to the Secretaries of State the exercise of the power to decide on certain matters or in specific cases.
That the resources for the functioning and operation of the Presidential Office for Project Monitoring (OPSP), were allocated in the current Fiscal Year 2018 in the General Budget of Income and Expenses of the Republic of the State Secretariat in the Offices of the Presidency.
That in accordance with Executive Decree Number PCM-025-2018, published in the Official Gazette "La Gaceta" on July 10, 2018, in its Article, it establishes that "the Presidential Office for Project Monitoring (OPSP), shall be attached to the Presidency of the Republic, therefore the budget allocated for its functioning in the General Budget of Income and Expenses of the Republic for Fiscal Year 2018, must be transferred to the Presidency of the Republic".
That through Executive Agreement 1 published in the Official Gazette "La Gaceta" dated Twenty (20) of April 2018, the Constitutional President of the Republic Juan Orlando Hernández Alvarado, delegated to the State Secretary Coordinator General of Government, by Law, Martha Vicenta Doblado Andara, the power to sign Executive Agreements that according to the Law of Public Administration, are the power of the President of the Republic to sanction.

Presidencia de la República ACUERDO EJECUTIVO No. 050-2018 El Presidente Constitucional de la República, CONSIDERANDO: Que de conformidad con el Artículo 245 numerales 2, 11 y 19 de la Constitución de la República, corresponde al Presidente de la República, entre otras Atribuciones: Dirigir la política general del Estado y representarlo, emitir Acuerdos, Decretos y expedir Reglamentos y Resoluciones conforme a la Ley, así como administrar la Hacienda Pública. CONSIDERANDO: Que de conformidad al Artículo 248 de la Constitución de la República, establece que los Decretos, Reglamentos, Acuerdos, órdenes y Providencias del Presidente de la República, deberán ser autorizados por los Secretarios de Estado en sus respectivos ramos. CONSIDERANDO: Que de conformidad al Artículo 16 de la Ley General de la Administración Pública, el Presidente de la República podrá delegar en los Secretarios de Estado, el ejercicio de la potestad de decidir en determinadas materias o en casos concretos. CONSIDERANDO: Que los recursos para el IXQFLRQDPLHQWR\RSHUDFLyQGHOD2¿FLQD3UHVLGHQFLDO de Seguimiento de Proyectos (OPSP), fueron asignados en el actual Ejercicio Fiscal 2018 en el Presupuesto General de Ingresos y Egresos de la República de la Secretaría de Estado en los Despachos de la Presidencia. CONSIDERANDO: Que de conformidad con el Decreto Ejecutivo Número PCM-025-2018, publicado HQHO'LDULR2¿FLDO/D*DFHWDHOGHMXOLRGHO HQVX$UWtFXORHVWDEOHFHTXH³OD2¿FLQD3UHVLGHQFLDO de Seguimiento de Proyectos (OPSP), estará adscrita a la Presidencia de la República, por lo que el presupuesto asignado para su funcionamiento en el Presupuesto General de Ingresos y Egresos de la República para el Ejercicio Fiscal 2018, debe ser trasladado a la Presidencia de la República”. CONSIDERANDO: Que mediante Acuerdo Ejecutivo 1 SXEOLFDGR HQ HO 'LDULR 2¿FLDO /D *DFHWD HQ IHFKD Yeinte (20) de abril del 2018, el Presidente Constitucional de la República Juan Orlando Hernández Alvarado, delegó en la Secretaria de Estado Coordinadora General de Gobierno, por Ley, Martha Vicenta Doblado Andara, la potestad dH¿UPDU$FXHUGRV Ejecutivos que según la Ley de la Administración Pública, son potestad del Presidente de la República su sanción. POR TANTO, En uso de las facultades de que está investido, y en aplicación de lo establecido en los Artículos 205
numerales 2 y 11, 248 de la Constitución de la República; Artículos 16, 116 y 118 de la Ley General de la Administración Pública; Artículo 37 de la Ley Orgánica del Presupuesto; Artículo 10 del Decreto Ejecutivo Número PCM-025-2018; y, Acuerdo Ejecutivo N°. 023- 2018. ACUERDA: PRIMERO.- Ampliar en el Presupuesto General de Ingresos y Egresos de la República, Ejercicio Fiscal 2018 la asignación presupuestaria siguiente: Institución: 020, Presidencia de la República Programa: 11 Subprograma: 00 Proyecto: 000 Actividad/Obra: 001, Presidencia de la República Objeto del Gasto: 93100, Gastos Corrientes de la Presidencia de la República Total ampliación: OCHO MILLONES SETECIENTOS NOVENTA Y TRES MIL CON VEINTIDOS LEMPIRAS EXACTOS (L 8,793,022.00). SEGUNDO.- /D DPSOLDFLyQ DQWHULRU VHUi ¿QDQFLDGD de la asignación presupuestaria siguiente: Institución: 0030, Secretaría de la Presidencia Programa: 01 Actividades Centrales Subprograma: 00 Proyecto: 000 Actividad/obra: 001 Dirección y Coordinación Superior Ejecutiva Objeto del Gasto: 24710, Servicios de Consultoría, de Gestión Administrativa, Financiera y Actividades Conexas. Importe L. 8,793,022.00 Total que se afecta: OCHO MILLONES SETECIENTOS NOVENTA Y TRES MIL CON VEINTIDOS LEMPIRAS EXACTOS (L 8,793,022.00).
